The family courthouse on Main Street smelled of floor wax, old paper, and quiet desperation—a stark contrast to the sterile tech office where this nightmare had first begun less than twenty-four hours ago.
I sat at the wooden counsel table alongside my attorney, Sarah Vance, a sharp family law specialist who didn't blink when I slid the police report and hospital photographs across her desk.
Across the aisle sat Lena, flanked by a public defender who looked like he wanted to be anywhere else in the world.
Judge Thomas, a stern-faced veteran of the family court bench, adjusted his reading glasses and looked down at the emergency filing.
"Mr. Bennett," the judge began, his deep voice echoing in the quiet courtroom. "You are seeking immediate, temporary sole custody of the minor child, Noah Bennett, citing gross endangerment and domestic violence involving a third-party cohabitant."
"Yes, Your Honor," I stood up, my voice steady and clear. "The cohabitant, Travis Miller, physically assaulted my four-year-old son with a baseball bat yesterday afternoon while the mother was away from the premises. We have police reports, medical documentation, photographic evidence of defensive injuries, and an active felony arrest warrant."
Lena choked back a sob from across the aisle, her public defender leaning over to whisper a hurried caution into her ear.
Judge Thomas flipped through the pages of the medical report, his expression growing darker with every turn.
When his eyes reached the photographs of Noah's bruised forearm, he lowered the papers and looked directly at Lena.
"Ms. Bennett," the judge said coldly. "Do you deny these allegations?"
Lena stood up, trembling, her hands clasped tightly in front of her. "Your Honor... I didn't hit him! It was Travis! I didn't know he had that kind of temper, I swear! I'm a good mother—"
"A good mother does not invite violent felons into a home where a four-year-old child sleeps," Judge Thomas interrupted, his tone leaving zero room for argument. "The court finds an immediate and grave threat to the safety and welfare of the minor child."
He picked up his heavy gavel.
"Emergency sole custody is granted to the father, Mark Bennett, effective immediately. Mother’s visitation is suspended pending a full psychological evaluation and a guardian ad litem investigation. Case adjourned."
